There is a paragraph in the subscriber agreement that says:

"(a) The ISP Service as offered and provided under this Agreement is a residential

But the context implies this applies to hosting websites for other parties.  And
it doesn't mention mail servers at all.

No.  IIRC, the scanning is looking for open mail relays.
Many people have been running servers for years...with no problems, AFAIK.

They DO explicitly state they have a right to monitor and limit excessive bandwidth
consumption, however.  So if you are running a server that gets a lot of traffic,
you should be concerned.
