As we've mentioned, this CoC is based on the Ubuntu one:

http://www.ubuntu.com/community/conduct

Given the license on the Ubuntu one, we had to use that license.
Personally I think the license adds value in that it guarantees its
availability for use and re-use. Would you mind articulating your
criticism of the license a bit more?
