The CANSPAM laws prohibit unwanted email with a fine of about $16000 per
violation (per unwanted email). Not sure how often it is enforced.

So the opt-in/opt-out process is furly important. Single click opt-out is a
nice feature to keep you organisation out of the court room.

Also, something to consider, mail services like mailchimp have the ability
to see which email addresses will mark your email as spam before it sends
the bulk email. If mailchimp detects a high percentage of the recipients
consider your email spam.. mailchimp will not send the email and penalize
your account. They do this to prevent the mailchimp servers from being
flagged.
