Don't tell them that you are using one. Many of the cable ISP's are trying
to figure out what to do about those, as they feel that if you have two
computers behind a NAT firewall that you should be paying a surcharge for
that second computer. I haven't heard anything from Time Warner (yet) but no
need to tell them something that they don't need to know about.

They are a common carrier. You can file suit against them for anything but
I'm pretty sure you have a snowballs chance in hades of winning anything if
you're hacked.
While it is totally unreasonable for them to have to support 10 different
flavors of Linux, it is reasonable I think for them to make in-home service
calls where they plug a Windoze laptop into your cable modem directly to
diagnose whether the problem is on their side or yours. If the problem is on
your side, you pay for the in-home visit. If the problem is on their side,
they eat the bill. That is the most reasonable way I can think of for them
to "support" (or rather "permit") any OS you want. Of course they aren't
really supporting in the sense that you won't get someone there to walk you
through the configuration but at least they wouldn't have to hang up on you
if you told them you were running OpenVMS or something.
